Association Easements & Deed Restrictions
It has been brought to the Board’s attention that recreational vehicles (ATV’s & golf carts) have been utilizing the easement areas located in Summer Lake Ranch. According to or Deed Restrictions this is not allowed. Those areas are maintained and mowed on a regular basis and if they are rutted up and become unable to be accessed by the mowers it will cost the property owners more to repair the damage so they can continue to be maintained.
Below is the verbiage from the Deed Restrictions: AMENDED AND RESTATED SUPPLEMENTAL DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR SUMMER LAKE RANCH, SECTION 2 Section 2 - Supplemental Provisions (D) Reserve Areas: The Association shall have the power to adopt rules and regulations governing the use of the various platted reserves within the Section 2 Subdivision. The platted reserves within the Section 2 Subdivision are limited (by plat) to certain purposes including landscaping, utility, and drainage/detention purposes. To preserve such reserve areas, no Owner (nor such Owner’s guests, representatives, or invitees) may use the platted reserves within the Section 2 Subdivision for recreational or other purposes, unless expressly authorized by the Association. In connection with the foregoing, the Association may elect to assess fines against Owners who violate the provisions of this paragraph.
