Why are we conducting this election?
A vote of the members of Spring Branch Townhomes Homeowner’s Association, Inc. is currently underway to amend the Association’s Declaration of Covenants, Conditions, and Restrictions. The only proposed change, compared to the previous proposed First Amended and Restated Declaration of Covenants, Conditions, and Restrictions, is in the responsibility for Front Yard Maintenance, listed as the second bullet point under Major Proposed Changes below.
Major Proposed Changes (if amendment passes):
- Monthly Installments: Annual assessments may be paid in equal monthly installments without penalty.
- Front Yard Maintenance: The Association will be responsible for maintaining all front yards, as they are currently being maintained. (No changes will be made to the current landscaping services, and the association will NOT be responsible for any replacement of landscape material.)
- Water Invoicing: The monthly water assessment will be added to the governing documents.
- Leasing Policy: The current Leasing Policy will be formally incorporated into the Restrictions.
Other Proposed Changes:
- Declarant: Removal of references to the Declarant, provisions no longer apply.
- Architectural Review Committee (ARC): Clarification of the role and responsibilities of the committee.
- Assessment Collections: Clarification of assessment collection procedures.
- Parking and Vehicle Storage: Definition of rules regarding parking and vehicle storage.
- Other: Additional minor updates for clarity and consistency.
Vote APPROVED to approve the First Amended and Restated Declaration of Covenants, Conditions, and Restrictions.
Vote DISAPPROVED not to approve the First Amended and Restated Declaration of Covenants, Conditions, and Restrictions.
